The most important factor in calculating a personal injury settlement is the scope and severity of the victim’s injuries. This often correlates to the cost of treatment, related out-of-pocket expenses, and the amount of lost wages.

Only an experienced personal injury attorney can determine the value of severe injury claims. They take into account future medical treatment, rehabilitation costs, loss of earning capacity, and the extreme emotional suffering caused by catastrophic injuries.

Other factors that influence injury payouts in Texas:

A multiple of one is appropriate for mild injuries that heal quickly, like minor sprains and bruising. A multiple up to three is reasonable for injuries that interfere with your activities of daily living, like the broken arm that kept you out of the pool with your kids all summer.

Plaintiff was taken to the emergency room and treated for a nose fracture. She also had significant bruising to her eyes and face. Plaintiff subsequently developed cognitive deficits. Defendant noted that there was no mention of a traumatic brain injury in medical records from date of the accident. Parties agreed to a $1,700,000 settlement.

In cases with more than one plaintiff, the payout reflects the highest amount awarded to one individual plaintiff.

Averages are calculated by adding the payouts for a group of cases, then dividing by the number of cases in the group. An unusually high award can skew the average higher for the group.
